Emerson Straw Files Wrongful Death Lawsuit After Slip and Fall in Hospital

On April 4, 2019, Emerson Straw, PL filed a wrongful death lawsuit in the Pinellas County circuit court against St. Anthony’s Hospital and the Baycare Health System. The decedent simply needed to use the restroom inside of her St. Anthony’s Hospital patient room when she was caught off guard by a slippery floor. The lawsuit alleges that a hospital employee had recently cleaned the floor but neglected to place a sign or give a verbal warning of the hazard. When the decedent went to use the restroom, she slipped and fell, causing her head to hit the bathroom sink. Unfortunately, the injuries from this incident led to her death.

Under Florida law, St. Anthony’s Hospital owes a duty of care to remedy dangerous conditions within a reasonable amount of time or warn guests of the hazard. According to the lawsuit, St. Anthony’s failure to fix the slippery floor or warn the decedent of the danger proximately caused her death.

Wesley T. Straw, the case’s lead attorney, is seeking damages in excess of $15,000 for the decedent’s pain and suffering before death; the family’s loss of her service and support; medical and funeral expenses; lost income; and more.
