Late Cancer Diagnosis Lawsuit

The personal injury law firm Emerson Straw PL has won a $4.65 million verdict for a patient in a medical malpractice lawsuit. The case involved the primary care practice Defendant and its P.A. failing to order imaging of the 75-year-old Plaintiff’s persistent enlarged lymph node on his neck over an eight-month period.

The Plaintiff, Matthew Hines, had made multiple complaints about feeling the lump on his neck, but he was told by Defendants that it was due to his allergies. By the time a correct diagnosis of cancer was made, the cancer had spread to multiple lymph nodes and was Stage 4 neck cancer. The delayed diagnosis and advancement of the neck cancer complicated the Plaintiff’s treatment to the extent that he is tragically forced to live permanently on a tracheostomy and feeding tube.

This included $250,000 for past and future medical expenses and $4.4 million for past and future pain and suffering. The Defendant in the case was Access Healthcare Physicians LLC.
